Myrtle Mae Lilly1,2

F, b. May 14, 1941, d. November 1, 1970
Her Social Security Number was 236-66-7640.3 Myrtle Mae Lilly was buried at Blue Ridge Memorial Gardens, 5250 Robert Centre Byrd Drive, Prosperity, Raleigh Co., West Virginia.4,2 She was born on May 14, 1941 at Walkerton, Raleigh Co., West Virginia.1,4,2,3 As of January 3, 1964,her married name was Cochran.1 She married Thomas Edward "Tommy" Cochran, son of George Washington Cochran and Jessie Katherine Terry, on January 3, 1964 at Beckley, Raleigh Co., West Virginia.1 Myrtle Mae Lilly died on November 1, 1970 at Beckley, Raleigh Co., West Virginia, at age 29; Died after being shot by her husband.4,2,5 She The husband of a Prosperity woman who was fatally wounded in a shooting Sunday at her home has been charged with her murder. State police said Mrs. Myrtle Cochran, 29, was pronounced dead on arrival at a Beckley hospital with a 16-gauge gunshot wound to her left chest. Also, officers noted there were obvious signs that a scuffle had occurred in the bedroom of the home. The victim's husband, Thomas E. Cochran, 27, is being held in jail here pending the setting of his bond by Criminal Court Judge Harry L. McCreery. Mrs. Cochran, an employe of C&P Telephone Co. for 10 years was a member of Fundamental Baptist Church in Prosperity. Also surviving are a son, Thomas Jr. at home; daughter, Lisa Kay at home; brothers, Jerry Lilly of Prosperity, Raymond Lilly of Ashland, Ky., Estil Lilly in Vietnam; and sisters, Mrs. Viola Bevins of Royal Oak, Mich, and Miss Connie Lilly and Miss Sherry Lilly, both of Prosperity. on November 3, 1970.5 She A firearms expert with the Criminal Investigation Bureau of the State Police said the shot which killed Mrs. Myrtle Mae Cochran was fired from a distance of four feet when he testified in the murder trial for her husband Thomas Edward Cochran which opened in Raleigh County Criminal Court Monday. Cochran's attorney had said in his opening statement the couple was wrestling for the gun when it went off accidentally. Cochran was indicted in the January T971 term of court for the shooting which occurred Nov. 1, 1970, in the couple's Prosperity home. R. F. Langley, master sergeant in the state's Criminal Investigation Bureau and a firearms and toolmarks expert, testified he tested the .16 gauge shotgun introduced in evidence by locking it in a fixed position and then firing it from a wide range of distances into a desk blotter and from a comparison of these tests with the marks on the shirt Mrs. Cochran had been wearing determined the weapon was four feet from the victim. The shirt Mrs. Cochran was wearing also was admitted in evidence. Other witnesses giving testimony Monday were Mrs. Cochran's two sisters and a brother who made their home with the Cochrans. Miss Connie Lilly, 18, now living in Jacksonville, N. C., told the jury Cochran and his wife argued in their bedroom after Cochran had asked for the couple's checkbook, that she heard glass breaking followed by one gunshot, and that she then took the two younger children to a neighbor's home. Miss Lilly said Cochran left the house and when they both returned he called an ambulance. Under cross examination Miss Lilly said Cochran called the ambulance before leaving the house. Jerry Lilly, 14, now living with another sister in Michigan, said he phoned for the police while Cochran was away from the house and that Cochran called the ambulance after he returned. Jerry and his 13-year-old sister Sherry said they heard Cochran tell his wife, "I'll take this gun and blow your brains out," in a loud voice that could be heard throughout the house. Testimony indicated the children were playing cards in the dining room when Cochran came home that evening. When he arrived the children assembled in the living room, they all stated. State Police Trooper James White said Cochran telephoned headquarters at about 5:55 p.m. that evening and said that he and his wife were struggling over a shotgun that accidentally discharged and asked the police to come to his home. Tpr. White said he summoned troopers C. M. Blizzard and James Stacy to investigate the call. However, White said that be was the arresting officer because Blizzard was involved in other investigations at the time. White said Stacy accompanied him to a neighbor's home where Cochran was arrested. White said he did not question Cochran and took no statement. Tpr. Blizzard told the court that he talked with Miss Lilly, Sherry and Jerry after Cochran was arrested about four hours after the initial investigation. Blizzard said the arrest was prompted after a closer examination of the victim's body at the funeral home. Raleigh County Coroner Dr. Ross P. Daniel did not perform an autopsy, according to Blizzard, but did a visual examination at the funeral home. Thomas Edward Cochran of Prosperity testified he and his wife struggled over a loaded gun and that he does not know how it was discharged at the time Mrs. Cochran was killed when he took the stand in Raleigh County Criminal Court today. Cochran is on trial charged with murder in the shooting death of Myrtle Mae Cochran Nov. 1, 1970. On the day of the shooting Cochran said he had left the house about 11 a.m. and that a little later he played "nickel and dime poker" at a home in East Beckley. He said he had four drinks of whiskey in a period of two and a half to three hours and that the whiskey did not affect him. When he returned to his home in Prosperity about 5:45 p.m., he said he found his wife sitting on the bed in their room, that he asked her for some money, but she said she had none. Cochran then asked for their check book to which Mrs. Cochran replied, according to the defendant's testimony, "You know where it is. Go and get it." Cochran said he planned to go out again that day and that his wife disapproved. Cochran also said his wife "wasn't too fond of drinking to start with." When Cochran went to the kitchen and returned to the bedroom with a glass of beer, Cochran said in recounting events leading up to the shooting his wife "upended the glass," spilling the beer, and then he threw the glass, aiming at nothing in particular and at no one. At this point, Cochran said, Mrs. Cochran started pummeling him and then went toward a gun rack in the bedroom and as she reached for a gun, he also reached for it. While the two had their hands on the gun, they spun around and the gun went off, he said. Cochran also said in answer to questioning his wife had been disturbed about, prowlers and had requested that he show her how to use the gun a few days previously. He did so and at the time he admonished Mrs. Cochran's 14-year-old brother, Jerry, who lived with them, not to handle the gun. He said he does not know how the gun came to be loaded. Cochran described his attempts to help his wife, stating he had called state police and then got into his car intending to go for help but came back into the house thinking there was something he could do. On the advice of a neighbor, he attempted to give mouth to mouth resuscitation. He also called an ambulance. Cochran had not undergone cross examination at noon today. The state rested its case this morning following testimony by Dr. Ross P. Daniel that he examined the victim and described the point on her breast where the bullet entered. A number of character witnesses testified for the defense including the Mine Superintendent, Mike Rahall, at the Eccles mine where Cochran has been employed for the past six years and in a member of the Mine Rescue Team. Others who testified Cochran has a good reputation as a "peaceful, law abiding" citizen were Glen C. Smith of Prosperity; Grayson Plumley, manager of the PicWay Shoe Mart where Cochran had been employed; Howard Greene, a Town District constable, and J. L. Mabry, safety inspector at the Eccles Mine. The case is expected to go to the jury later this afternoon. Trial of the case began Monday and has been characterized by frequent differences between defense attorneys Anthony J. Sparacino and C. Elton Byron Jr. and the prosecutors, Thomas C. Canterbury and his assistant, Paul R. Hutchinson Jr. Canterbury objected particularly to admission of testimony by character witnesses who were not residents of the community in which Cochran lives, and to what he termed Sparacino's efforts to "lead the witness." on February 1, 1972.6 She In less than two hours of deliberation, a Raleigh County Criminal Court jury acquitted
Thomas Edward Cochran, 29, of Prosperity, charged with the shooting death of his wife, Myrtle Mae Cochran. Cochran went on trial here Monday morning and the case went to the jury at 4:50 p.m. Tuesday. The verdict of "not guilty" was returned at 6:40 p.m. on February 2, 1972.7
