State Police Capt. John W. Burrow said Yates was being taken to Floyd in Phipps' patrol car after being arrested on suspicion of drunken driving at Locust Grove. The prisoner apparently tried to escape, Burrow said, and Phipps stopped the car to handcuff him. During the struggle the trooper was injured on the head and neck and Yates was fatally wounded with one shot. Phipps was released after being treated at Roanoke Memorial Hospital. on May 31, 1965.⁴

She is also survived by brother Frank Steele (Pam) and many special nieces, nephews, friends and family. Funeral services will be 2 p.m. Wednesday at Salem Church (Head of The River) with Elder W. T. Conner and Mr. Buddy Frei officiating. Burial will be in Salem Cemetery (Head of The River). The family will receive friends from 7 to 9 p.m. Tuesday at the Maberry Funeral Home, Floyd. on July 18, 2000.⁸
